These Terms and Conditions (“Terms”) govern the EEA Futures Fee Waiver Promotion (the “Promotion”). By participating, you agree to be bound by these Terms and Kraken’s Terms of Service.

Section 1 — Sponsor

This Promotion is sponsored by PEDSL-CY (Payward Europe Digital Solutions (CY) Limited, CySEC licence 342/17).

Section 2 — Eligible Areas

The Promotion is open only to verified Kraken Pro users residing in the European Economic Area (“EEA”), excluding any jurisdictions where such promotions are prohibited or restricted by law.

Section 3 — Promotion Period

The Promotion begins on the date communicated by Kraken and ends on July 19, 2026, following a participant’s successful enrollment or qualification for the Promotion (“Promotion Period”).

Section 4 — How to Participate

To qualify for the Promotion, participants must:

1. create a new Kraken account during the Promotion Period;
2. complete identity verification and activate a Kraken Pro account;
3. reside in an Eligible Area; and
4. comply with the Kraken Terms of Service and all applicable laws and regulations.

Eligible participants will automatically receive the Promotion benefits upon qualification.

Section 5 — Promotion Benefits

Fee Waiver Benefit

For the duration of the Promotion Period, Kraken will waive:

5. 100% of maker fees; and
6. 100% of taker fees

on eligible futures transactions (perpetual futures) executed through the participant’s Kraken account.

The fee waiver applies only to the first US$10,000,000 equivalent in cumulative futures trading volume executed during the Promotion Period.

Once either:

7. the participant reaches US$10,000,000 equivalent in cumulative futures trading volume; or
8. the thirty (30) day Promotion Period expires,

standard Kraken fee schedules will apply automatically.

This Promotion is non-transferable, has no cash value, and may not be exchanged or substituted. Other costs and charges may apply.

The discounted fees may take up to 24 hours to reflect in your account.

Section 6 — Eligibility

You are eligible to participate only if, at the time of qualification and throughout the Promotion Period, you:

9. reside in an Eligible Area;
10. have created a new Kraken account during the Promotion Period;
11. have completed identity verification and activated a Kraken Pro account;
12. have no prior or existing Kraken account at the time of registration;
13. agree to the Kraken.com Terms of Service; and
14. are not otherwise prohibited from participation under applicable law.

Section 7 — Disqualification

Kraken reserves the right, in its sole discretion, to disqualify any participant who:

15. violates these Terms;
16. violates the Kraken.com Terms of Service;
17. provides false, inaccurate, or misleading information;
18. engages in fraudulent, abusive, manipulative, wash trading, self-dealing, or other non-bona fide activity;
19. attempts to circumvent eligibility restrictions through multiple accounts or any other means; or
20. is found to hold or have held a prior Kraken account at the time of registration.

Kraken may revoke Promotion benefits retroactively where prohibited conduct is identified.

Section 8 — Notification and Administration

Eligible participants may be notified through email, in-app messaging, or other communication channels used by Kraken.

Kraken’s determinations regarding eligibility, qualification, trading volume calculations, and Promotion administration are final and binding.

Section 9 — Consents and Privacy

By participating, you consent to Kraken’s collection, use, and disclosure of personal information for purposes of administering the Promotion and complying with applicable legal and regulatory obligations.

Section 10 — Disclaimers

Kraken is not responsible for interruptions, delays, technical failures, network outages, or any other circumstances that may affect participation in the Promotion.

Kraken reserves the right to modify, suspend, or terminate the Promotion where necessary due to legal, regulatory, technical, security, operational, or business considerations.

Section 11 — Limitation of Liability, Disputes, and Governing Law

By participating in this Promotion, you agree to and hereby release and hold harmless PEDSL-CY (Payward Europe Digital Solutions (CY) Limited) and its affiliates, officers, directors, employees, and agents (collectively, “Kraken”) from any damage, injury, death, loss, claim, action, demand, or other liability arising out of or in connection with your participation in this Promotion or the acceptance, use, or misuse of any benefit.

TO THE EXTENT PERMITTED BY APPLICABLE LAW:

21. ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED, IF ANY, NOT TO EXCEED TWENTY-FIVE US DOLLARS (USD $25.00). ATTORNEYS’ FEES ARE NOT RECOVERABLE;
22. YOU WAIVE ALL RIGHTS TO SEEK PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, OR LOST PROFITS; AND
23. YOUR REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES ONLY.

Dispute resolution and governing law are governed by the Kraken Terms of Service applicable to you, available at https://www.kraken.com/legal/eea-terms, including all dispute resolution and governing law provisions contained therein. Section 12 — Taxes

Participants are solely responsible for any taxes, duties, or reporting obligations arising in connection with participation in the Promotion. Kraken does not provide tax advice. Participants should consult their own tax advisers regarding the tax treatment of any benefit received.

Section 13 — General Terms

Kraken reserves the right to amend, suspend, or terminate this Promotion at any time.

Failure by Kraken to enforce any provision of these Terms shall not constitute a waiver of that provision.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Kraken’s decisions regarding all aspects of the Promotion are final and binding.
